Terms of service
These Terms and Conditions (“Terms”) define the rules for using the online service available at www.auroom.work (the “Service”), operated by AuRoom Staffing Solutions sp. z o.o., with its registered office in Zielona Góra, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000849768, NIP: 9292040211, REGON: 386503213 (the “Administrator” or the “Company”).
1. General Provisions
a) The Terms in particular set out:
i) the rules for registration and maintaining a user account,
ii) the principles of processing and protecting personal data,
iii) the conditions of use of free and paid services,
iv) the rights and obligations of Users and the Administrator,
v) the principles of legal liability and limitations of liability.
b) Use of the Service constitutes acceptance of these Terms.
2. Definitions
a) User – a person with full legal capacity who has registered in the Service by providing their email address and creating a password necessary to access the account.
b) Employer – a User being either a legal entity or a person with full legal capacity who has registered in the Service by providing their email address and creating a password necessary to access the account, and who additionally has access to functionalities enabling the posting of job offers and searching for candidates, upon verification of a valid tax identification number (NIP).
c) Candidate – a User seeking employment through the Service.
d) Account – an individual User account created during registration.
e) Services – all services provided electronically within the Service, both free and paid.
3. Registration and Account
a) Registration in the Service is voluntary and free of charge.
b) The User is obliged to provide truthful data.
c) The User may delete their Account at any time through the User panel or by contacting the Administrator by sending an email to it@auroom.pl.
d) Deleting the Account does not result in the immediate removal of personal data, which the Administrator is entitled to store for the period provided by law, in particular the GDPR, as well as within the scope of the Administrator’s legitimate interest (e.g., securing claims). However, personal data is encrypted and accessible exclusively to the Administrator. The Administrator will permanently delete the User’s personal data upon direct request received by email at it@auroom.pl.
4. Personal Data
a) The administrator of personal data is AuRoom Staffing Solutions sp. z o.o.
b) Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (“GDPR”) and the Polish Personal Data Protection Act.
c) Users’ data is stored on secure servers of the Administrator, in compliance with the highest technical and organizational standards.
d) Data is processed for the following purposes:
i. enabling the use of the Service,
ii. assisting Candidates in finding employment,
iii. assisting Employers in finding employees,
iv. fulfilling the Administrator’s legal obligations,
v. marketing of the Administrator’s own services and services of business partners (including communications regarding job offers, changes in immigration regulations concerning foreign workers in Poland, promotions, industry events, and informational materials).
vi. Users’ data may be shared with the Administrator’s business partners solely to the extent necessary to achieve the purposes specified in items ii–iii above.
vii. The User has the right to withdraw consent for marketing at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
5. Users’ Rights under GDPR
The User has the right to:
a) access their personal data,
b) rectify personal data,
c) delete personal data (“right to be forgotten”),
d) restrict processing,
e) data portability,
f) object to processing,
g) lodge a complaint with the President of the Personal Data Protection Office (UODO).
6. Paid Services and Subscriptions
a) Basic registration and use of the Service are free of charge.
b) The User may purchase additional subscription packages providing access to extended functionalities.
c) The subscription is payable in advance for a selected billing period and remains valid until the end of that period, even if terminated earlier.
d) The subscription may be canceled at any time.
e) The Administrator does not provide refunds for any unused subscription period, due to the possibility of cancellation at any time.
7. Rules of Using the Service
a) The User undertakes to use the Service in accordance with the law and good practices.
b) It is prohibited to:
i. post false, misleading, or third-party rights-infringing content,
ii. take actions aimed at disrupting the operation of the Service,
iii. copy or use the contents of the Service for commercial purposes without the Administrator’s consent.
8. Intellectual Property Rights
a) All content, materials, graphics, layouts, and databases available in the Service are the property of AuRoom Staffing Solutions sp. z o.o. and are protected by copyright law and industrial property law.
b) Any copying, reproduction, distribution, or commercial use of the Service’s content without the Administrator’s consent will result in legal action to the fullest extent permitted by law.
9. Liability
a) All information available in the Service is for informational purposes only and does not constitute an offer within the meaning of the Civil Code.
b) The Administrator is not responsible for the content posted by Users or the accuracy of the data contained in job postings.
c) The Administrator does not guarantee employment or the finding of an employee.
10. Termination of Agreement
a) The User has the right to terminate the agreement at any time by deleting their Account.
b) The Administrator may terminate the agreement with a User in the event of gross violation of these Terms.
11. Final Provisions
a) These Terms are governed by Polish law and European Union law.
b) In matters not regulated by these Terms, the provisions of the Civil Code, the Act on the Provision of Electronic Services, and the GDPR shall apply.
c) Any disputes arising from the use of the Service shall be resolved by the competent common court with jurisdiction over the Administrator’s registered office.
d) The Administrator reserves the right to amend these Terms, of which the User will be notified electronically.
